Terms of Service - Social Tradies

This Terms of Service Agreement (the “Agreement”) sets forth the terms and conditions on which the Client (the “Client”) has engaged Social Tradies to complete any service (the “Services”) as outlined herein. This is a legally binding agreement between the Client and Social Tradies. In becoming a Social Tradies client, the Client agrees to be legally bound by the terms and conditions outlined in this agreement.

This agreement may be amended at Social Tradies sole discretion. An email communication sent to the Client’s last known email address will be deemed sufficient notice of any changes in this agreement. 

The “effective date” of this agreement is the date the Client pays for their first order for services to Social Tradies.

 1. Services:

Social Tradies will provide services to the Client as outlined on the Social Tradies website, www.SocialTradies.co.uk.

2. Social Tradies Obligations:

2.1 Social Tradies will provide services to the Client in accordance with Social Tradies policies and procedures.

2.2 Social Tradies reserves the right to reject clients at their sole discretion.

2.3 Social Tradies will be responsible for all aspects of providing the services.

2.4 All Social Tradies rules, pricing, policies and operating procedures concerning privacy, pricing, customer service, and all other aspects of the services will apply.

2.5 Social Tradies may change its rules, pricing, policies and operating procedures at its sole discretion. Existing clients will be notified at least 30 days in advance of any changes made. 

3. Fee and Payment:

3.1 All fees for services provided to the Client are due and payable in full on the due date within a recurring payment schedule. This includes monthly, 3 or 6-monthly, before the provision of the services.

3.2 Once Social Tradies reaches the legal threshold, all charges will be subject to UK law in terms of VAT.

3.2 A valid credit or debit card shall remain securely on file to cover recurring service charges and be shared with GoCardless, contracted to provide Social Tradies with payment collection and scheduling.

3.3 All charges for the services provided by Social Tradies will be paid in advance. If a card payment fails, Social Tradies will automatically notify the client and make two further attempts at payment within seven days. If payment still hasn’t been received, the related service provided by Social Tradies will stop immediately unless an agreement has been reached.

3.4 Refund Policy: Except in the case of a material breach of this agreement by Social Tradies, Social Tradies does not issue refunds of any fees for any reason beyond the first 14 days of the Client’s effective date.

3.5 The 14-day money-back guarantee applies to the Client’s first order with Social Tradies. Refunds requested within the 14-day money-back guarantee period will only be processed once all social media posts created and published on the Client’s social media profiles have been deleted.

3.6 Cancellation Policy: The Client can cancel a subscription by emailing a cancellation request to Hello@SocialTradies.co.uk, kindly noting the reason for cancellation.

3.7 Social Tradies does not issue prorated refunds for cancellations once payment has been received but will complete the service if requested.

3.8 Returning clients: If a client chooses to return to the service within 12 months of cancelling, the service agreed to will continue as an existing client. If a client chooses to return after 12 months or under a new business name, then this will be treated as a new client. 

4.Service Provided:

4.1 Social Tradies service will begin once the initial payment is received. At this point, Social Tradies will complete the first set of posts within five working days.

4.2 Publishing Software: Social Tradies uses third-party social media publishing software to schedule and publish the Client’s social media posts. As such, Social Tradies has no control over any issues occasionally caused by third-party publishing software. If a problem caused by third-party publishing software affects the services provided by Social Tradies to the Client, the Client agrees not to hold Social Tradies liable.

4.3 Profile disconnections: It is the client’s responsibility to ensure all social media profiles remain connected to maintain the service provided.

4.4 Social Tradies has no control over issues that may occur concerning profile disconnections.

4.5 If any of the Client’s social media profiles become disconnected from the scheduling portal, the Client will be notified via email to reconnect their chosen profiles. If the Client fails to reconnect their profiles to the scheduling portal, resulting in one or more unpublished posts, then it is the Client’s responsibility, and Social Tradies will not be held liable. Social Tradies will reschedule the posts when the Client reconnects their chosen profiles to the scheduling portal.

4.6 Post preparation: Social Tradies aim to complete all post schedules in 14-day cycles or twice per month, except the service commencement posts, which will be completed within five working days. This allows the content to be current and appropriate. Social Tradies reserves the right to reduce this once a month, which is industry standard practice.

4.7 Reviewing content: All posts created by Social Tradies are scheduled to be published automatically via the scheduling portal. Social Tradies will email the Client at least three days before new posts are published, allowing enough time for the Client to access the scheduling portal and review the scheduled posts.

4.8 It is the Client’s responsibility to access the scheduling portal to submit feedback on scheduled posts or request any revisions of any posts before they are published. For this reason, Social Tradies will not be held liable for any posts published that are deemed unsatisfactory by the Client.

4.9 The Client is encouraged to regularly access the scheduling portal to review new content, provide feedback, and report any issues that may occur.

4.10 If the Client cannot access the scheduling portal for any reason, they must notify Social Tradies immediately. 

4.11 Social Tradies reserves the right to share any posts created in any format with the client.

4.12 Social Tradies reserves the right to repurpose content.

4.13 Social Tradies will only use logos and testimonials provided or posted on the client’s website.

4.14 Social Tradies provides a unique ‘Add A Post’ service. When clients request this service as part of their package, Social Tradies will create a post using the information supplied by the client, which will be scheduled within 24 hours or 48 hours, depending on the package.

5. Warranty Disclaimers:

Social Tradies expressly disclaims any warranties regarding or related to this agreement, the services, or any materials or assistance provided to the Client, express or implied, including without limitation, warranties or merchantability, course of performance or dealing, trade practice, title, non-infringement, and fitness for a particular purpose.

6. Indemnity:

The Client will indemnify and hold harmless Social Tradies and its customers, suppliers, directors, officers, agents, and employees from and against any losses, costs, damages, liabilities, and expenses (including, without limitation, reasonable solicitor fees) arising out of or relating to any breach by the Client of any of the terms of this agreement.

7. Limitation of Liability:

Social Tradies shall not be liable to the client or any entity or person claiming through or under the client for any loss of profit or income or other indirect, consequential, incidental, or special damages, whether in an action for contract or tort, in connection with this agreement, even if Social Tradies has been advised of the possibility of such damages. Under no circumstances shall Social Tradies liability to the client hereunder exceed the amount paid to Social Tradies by the client for the previous one month of services. This limit is cumulative, and the existence of more than one claim will not increase the limit.
